ProofStrike legal
ProofStrike Privacy Policy
How ProofStrike handles account, creator, discovery, evidence, enforcement, support, and technical information during controlled access.
1. Who operates ProofStrike and how to reach us
ProofStrike is operated by Chase Gaskins as a sole proprietor under the ProofStrike name (“ProofStrike,” “we,” “us”). The contact for privacy and support requests is [email protected]. ProofStrike does not publish a business mailing address at this time; a current mailing address may be requested through that email after identity and purpose are verified.
We take reasonable steps to verify the identity and authority of a person making a privacy request. If we process information for a business or agency customer, that customer may also control decisions about the data it supplies.
2. Information we process
Depending on which features are enabled for your account, we may process:
- Account and organization information: names, email addresses, login identifiers, profile and creator names, organization memberships, invitations, roles, contact details, authentication events, and account preferences.
- Original works and creator-submitted content: works, images, videos, previews, file metadata, titles, ownership statements, source URLs, channel identifiers, connected-account metadata, and proof of authorization.
- Discovery and monitoring information: scan requests and settings, potential matches, referenced locations, results and review decisions, dates of checks, and possible repeat appearances.
- Enforcement and evidence information: infringement allegations, Case information, recipient information, notices and communications, authorization information, supporting evidence, submission statuses, disputes, and related records.
- Payment and commercial information, if billing is enabled: subscription selection, entitlements, usage credits, invoices, transaction references, payment status, and limited payment-provider identifiers. Payment credentials are handled through the payment provider’s hosted or integrated processes rather than intentionally stored by ProofStrike as complete card numbers.
- Technical and usage information: IP addresses, device and browser information, cookies or local-storage tokens, access logs, security events, session data, error reports, rate limits, performance measurements, and interactions with the Services.
- Communications: support requests, pilot applications, marketing inquiries, complaints, data-rights requests, and correspondence.
We may process information about third parties appearing in creator-uploaded works, source pages, claims, notices, or reports. Do not submit material you lack authority or a lawful basis to provide.
3. Why we use information
We use information to operate accounts and authorized workspaces; verify rights-holder and agent instructions; store and present Originals; conduct configured discovery and similarity checks; evaluate potential Findings; assemble evidence records and notices; route and track authorized submissions; operate configured monitoring and recurrence workflows; protect service integrity and prevent abuse; provide support; meet billing and accounting obligations when applicable; comply with law; enforce agreements; and respond to valid legal requests.
A detection or similarity score is not a legal determination that infringement occurred. A discovered URL is not proof that material was removed. We distinguish observations, notices prepared, notices sent, provider acceptance, removal, and reappearance according to available records.
4. Creator authorization and outside providers
Where a creator requests searches or enforcement, we rely on the creator’s instructions and stated rights or agency authority. We use service providers for functions such as site delivery and security, application hosting, storage, communications, configured search or discovery, and payment processing when enabled. The public website is delivered through Cloudflare and may use Cloudflare Web Analytics or related security services.
Depending on the feature selected, we may share submitted content or information relating to it with third-party services to search for potential unauthorized uses. Transmitted material may include source URLs, search instructions, identifiers, fingerprints, derived metadata, thumbnails, previews, or an image or file when visual matching requires it.
Authorized enforcement workflows may transmit claimant contact details, affected URLs, rights representations, notice text, and selected supporting evidence to website operators, hosting providers, search services, platforms, or their agents. Outside recipients control their own copies and retention under their terms and applicable law.
5. Sharing and disclosure
We may disclose information to:
- service providers assisting with hosting, storage, security, technical processing, communications, and payment;
- recipients of authorized notices and disputes;
- collaborators and members within your organization according to configured access permissions;
- authorities or other parties where legally required or reasonably necessary to protect rights, safety, or service integrity; and
- a successor in a legitimate business transaction, subject to applicable law.
We do not claim that information transmitted to outside enforcement recipients remains under our exclusive control. The public website is not configured to sell personal information or use it for cross-context behavioral advertising. This statement does not designate ProofStrike as a controller or processor for every customer relationship; those roles depend on the applicable facts and agreement.
6. Cookies, authentication, and analytics
The authenticated Services use essential session and authentication data and browser storage needed to maintain security and account state. The public website may use technical identifiers for delivery, security, performance, and limited analytics. It does not use advertising cookies or marketing-advertising scripts operated by ProofStrike.
Browser privacy preferences may affect optional features. We will provide consent or opt-out controls where required by applicable law.
7. Retention, deletion, and evidentiary preservation
We retain information for the period needed to provide the Services, enforce agreements, protect against fraud, comply with legal duties, and preserve legitimate evidence or audit records. No category-specific public retention duration or backup-deletion schedule is promised by this policy.
Deleting an account or an Original does not necessarily erase records already included in an enforcement notice, legally preserved evidence, security records, payment or accounting records, backups, or materials held by outside recipients. Account closure may end access and sessions while Cases, Evidence, billing, audit history, organization chronology, and legally relevant delivery history remain preserved. Evidence subject to legal hold remains retained. Materials already sent to outside recipients are outside ProofStrike’s exclusive control.
We evaluate deletion requests under applicable law and legitimate preservation needs. Where appropriate, we delete, restrict, or de-identify qualifying records.
8. Security and integrity
We use safeguards intended to protect information, restrict unauthorized access, and support record integrity. No security measure can guarantee absolute protection. We investigate suspected security incidents and provide notifications when required by applicable law.
9. Rights and choices
Subject to applicable law and verification, you may request access to personal information we hold about you, correction of inaccuracies, deletion or restriction of qualifying information, and information about our processing. Certain records may be retained for legal, security, billing, dispute, evidence, or audit purposes.
Marketing messages, if any, will provide a lawful opt-out path. Submit requests to [email protected]. Where we handle data on behalf of an organization, we may direct a request to the applicable organization administrator.
Privacy rights differ by residence and applicable law. This policy does not imply that every statutory privacy regime applies to ProofStrike or waive rights where a law does apply. ProofStrike is currently offered through controlled access rather than general geographic-market availability.
10. Children and sensitive material
ProofStrike operational accounts are intended for rights holders and authorized representatives who are 18 years of age or older and able to enter a binding agreement. ProofStrike does not independently verify age through an automated age-verification service.
Users may upload material depicting other individuals and must have adequate rights and permission to do so. The Services must not be used to exploit minors, expose unlawful intimate material, dox, harass, or evade third-party access controls. Report suspected unlawful material through [email protected] and, where urgent, to the relevant platform or authorities. We may restrict access and follow applicable reporting and preservation duties.
11. International processing
ProofStrike is operated in the United States. Service providers may process or route information in other countries where they operate. ProofStrike does not currently make a public regional data-residency commitment or represent that EU- or UK-specific transfer arrangements have been established. Controlled access may be assessed before admitting a geography that requires additional transfer or localization terms.
12. Changes to this policy
We may update this policy as our practices or legal obligations change. We will publish a new effective date and provide additional notice or obtain consent when required by law. Material changes will not be used to retroactively authorize processing that requires fresh permission.
